Access to the Website

These General Terms and Conditions of Access and Use regulate access to and use of the Website that K Residence makes available to Internet users and that is intended to provide the User with information on K Residence.

Access to and use of the Website by the User implies the acceptance of these General Terms and Conditions of Access and Use.

If you do not accept these General Terms and Conditions, please refrain from using the Website and its content.

 

Use of the Website

The User undertakes to make diligent use of the Website, as well as the information contained therein, fully subject to both the applicable regulations and these General Terms and Conditions of Access and Use.

The User also undertakes to not carry out any act to damage, disable and/or overload the Website or that might prevent in any way the normal use and/or operation thereof.

K Residence reserves the right to withdraw, unilaterally and at any time, any contents from the Website, when due to the nature thereof K Residence considers it appropriate to do so.

The User is hereby informed that if they fail to comply with the General Terms and Conditions of Access and Use, or any other terms or conditions provided in the Website, K Residence reserves the right to limit, suspend and/or terminate their access to the Website, adopting any technical measure necessary for such purpose.

K Residence makes its best efforts to keep the Website in good working order, avoiding errors or, as the case may be, rectifying them and keeping the contents of the Website duly updated. However, K Residence does not guarantee the availability and continuity of access to the Website or the absence of errors in its contents, nor the timely updating thereof.

K Residence reserves the right to make, at any time and without prior notice, changes, deletions and/or updates to the information contained on the Website, its layout or settings.

Both access to the Website and any use of the information contained therein are the sole responsibility of the User.

K Residence shall not be responsible for any damage and/or loss arising, directly or indirectly, from access to or use of the information contained on the Website and, especially, any information on third parties other than K Residence, including, but not limited to, products in the computer systems or any damage caused by the introduction of viruses and/or cyber attacks, nor shall it be responsible for any damage to Users resulting from inadequate use of the Website or downtime, interruptions, absence and/or failure of the communications.

In addition, K Residence shall not be responsible for any damage to the User’s hardware or software resulting from access to the Website.

Nor shall K Residence be responsible for information sent by the User when it has no actual knowledge that the information is unlawful or that it may infringe the rights of third parties. As soon as it actually becomes aware that it contains data such as the aforementioned, K Residence undertakes to act diligently to remove them.

The User will be liable for any type of damage caused to K Residence as a result of the breach of any of the obligations to which he/she is subject under the General Terms and Conditions of Access and Use, or applicable law in relation to use of the Website.

K Residence can include on its Website advertising content and/or third-party sponsorship.

Advertisers and sponsors shall be solely responsible for ensuring that the material sent for its inclusion on the Website complies fully with the applicable law in each case.

As a result, K Residence shall not be responsible for any error, inaccuracy and/or irregularity included in the advertising or sponsors’ content

a) Links to the Website

 Any third parties intending to include a link on a website (“Linking Site”) to the Website, or a frame with it, must have the prior, express and written consent of K Residence.

In no case does the authorization granted by K Residence mean that it endorses, promotes, guarantees and/or recommends the content and/or the services of the Linking Site, nor is it responsible for the content thereof.

The Linking Site must comply with current law and in no case shall it contain own or third party content that is unlawful and/or inappropriate or not relevant (violent, racist, denigrating, etc.) in relation to K Residence’s activity.

If any of the above-mentioned terms are breached, K Residence will immediately proceed with the withdrawal of the consent granted to the Linking Site, which must remove the link.

b) Links to other websites

Various links that allow the User to access other websites (“Linked Sites”) can be included on the Website.

In no case does the existence of Linked Sites entail K Residence’s recommendation, promotion, identification and/or conformity with the statements, content and/or services provided through the Linked Sites.

As a result, K Residence shall not be responsible for the content, terms and conditions of use, privacy policies and other terms or conditions of the Linked Sites, with the User being solely responsible for checking and accepting them every time they access and use them.

 

Industrial and intellectual property

Without prejudice all intellectual property rights, designs, databases, underlying software (including source codes), as well as the various elements of the Website (texts, graphics, photographs, videos, sound recordings, combinations of colors, etc.) [the “Content”], their structure, selection and order, are the property of K Residence or, as the case may be, its licensors.

The distinctive signs included on the Website are the property of K Residence or its licensors.

By means of these General Terms and Conditions of Access and Use, the User is expressly prohibited from the reproduction, transformation, distribution, public communication, provision, extraction and/or any other form of dissemination not expressly authorized of the Website, its Content and/or the distinctive signs and domain names owned by K Residence.

The unauthorized use of the Content, as well as any damage caused to the intellectual and industrial property rights of K Residence, may give rise to the taking of whatever actions it is legally entitled to and to any responsibilities arising therefrom.

The use of the Website by the User does not imply the assignment to them by K Residence of any intellectual and/or industrial property right over the Website and Content.

 

Severability

Should any clause of the General Terms and Conditions of Access and Use be declared to be partially or wholly invalid or unenforceable, such invalidity or unenforceability shall solely affect said provision or the part of the same that is considered invalid or unenforceable, and all other parts shall remain in force, omitting said provision or the invalid or unenforceable part thereof.

For such purposes, the General Terms and Conditions of Access and Use shall only cease to be applicable exclusively in relation to the invalid or unenforceable provision, and no other part or provision of the same shall be invalidated, impaired or affected by such invalidity or unenforceability.

Governing law and jurisdiction

Access to and use of the Website shall be governed and construed in accordance with Azerbaijan law.

In the event of any conflict or dispute in the interpretation and/or application of the General Terms and Conditions, the competent courts will be those established in the applicable legal regulations.
